SENATE CONCURRENT RESOLUTION NO. 32

Requesting the Joint Committee on Government and Finance conduct
an interim study on authorizing licensed motor vehicle dealers
to sell "as-is" vehicles.

Whereas, An "as-is" vehicle is a used vehicle without a
warranty; and

Whereas, Currently, only government entities, banks, financial
institutions and individuals are authorized to sell "as-is"
vehicles in West Virginia; and

Whereas, All the bordering states authorize licensed motor
vehicle dealers to sell "as-is" vehicles; and

Whereas, The state is losing revenue to its bordering states;
and

Whereas, The West Virginia consumer is being deprived of
"as-is" vehicles at a reasonable price; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is
requested to review, examine and study, during the interim of the
Legislature, authorizing licensed motor vehicle dealers to sell
"as-is" vehicles; and, be it

Further Resolved, That all interested parties, including the
attorney general, the consumer protection division, licensed motor
vehicle dealers and consumers, be a part of the interim study; and
be it

Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2002, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations; and
be it

Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
